Legal Requirements for Building Granny Flats

In the Central Coast region of New South Wales, granny flats have emerged as a versatile solution to ever-growing housing demands. However, the path to constructing one is not always straightforward.

Navigating the maze of legal requirements can be a daunting task, even for seasoned property owners. From zoning laws to building permits, each step comes with its own set of complexities.

To demystify the process, this blog provides a comprehensive guide on the legal aspects of constructing a granny flat in the Central Coast.

Minimum Requirements Outlined in the State Environmental Planning Policy (Affordable Rental Housing) 2009

The State Environmental Planning Policy (Affordable Rental Housing), commonly referred to as the AHSEPP, was introduced to increase the supply and diversity of affordable rental and social housing in NSW. It provides a framework for developing secondary dwellings or granny flats.

Understanding these minimum requirements is crucial for anyone considering building a granny flat in NSW. The minimum requirements outlined in the AHSEPP are as follows.

General Provisions

  • One Primary Dwelling, One Secondary Dwelling: The development of a secondary dwelling can only result in one principal residence and one secondary dwelling on the site.
  • Subdivision: Subdivision of the land is not permitted.
  • Total Floor Area: The secondary dwelling is to have a maximum floor area of 60m². The maximum floor area of the principal and secondary dwellings should be per local council regulations.
  • Site Area: The minimum site area required is 450m².
  • Building Code of Australia (BCA): All relevant requirements within the BCA apply. Some secondary dwellings may result in a change in building classification under the BCA.

Complying Development Provisions

  • Partial/Internal Conversions: The AHSEPP allows converting part of the principal dwelling, structure, or garage into a secondary dwelling, provided it meets specific requirements.
  • Lot Requirements: The development should exclude environmentally sensitive land and heritage restrictions.
  • Height: The maximum height allowed is 8.5 metres.
  • Site Coverage and Floor Area: These are outlined in Schedule 1, Part 2, Clauses 3, 4, and 5 of the AHSEPP.
  • Landscaped Area: This varies depending on the size of the site and is outlined in Schedule 1, Part 4, Clause 16.
  • Privacy: New windows in the secondary or primary dwelling must have a privacy screen if they meet certain conditions.

Development Application Requirements

  • Site Area: The consent authority cannot refuse consent on the grounds of the site area if the site area is at least 450 square metres.
  • Parking: No additional parking is required on the site.

It’s advisable to consult the whole provisions of the AHSEPP, available at www.legislation.nsw.gov.au, for a comprehensive understanding.

Council Approval: Is it Necessary?

One of the most pressing questions homeowners have is whether council approval is required to build a granny flat. In the Central Coast region of NSW, the answer is generally “no,” but this comes with a caveat. Your property must meet the minimum requirements outlined in the AHSEPP.

If your property doesn’t meet these criteria, you may still be able to proceed, but you’ll need to go through a Development Assessment process with your local council. This is a more time-consuming and potentially costly route, so it’s crucial to understand the AHSEPP guidelines thoroughly.

Special Scenarios

Double-Storey Granny Flats

A double-storey granny flat particularly appeals to those looking to maximise space. While it is indeed possible to construct a two-level granny flat, there are specific regulations you must adhere to.

The total height of your property, including the granny flat, must be at most 8.5 metres. This height limitation ensures that the structure is in harmony with the surrounding residential area and does not impede neighbours’ views or privacy.

Before proceeding with a double-storey design, consult with professionals to ensure your plans align with local legislation.

Converting Part of Your House

Another option for homeowners is to convert a section of their existing property into a granny flat. This could be an unused garage, basement, or even a portion of the main house. However, this conversion must meet specific requirements set by the AHSEPP.

These include ensuring that the converted space is self-contained, has separate access, and meets all the zoning and size requirements applicable to standalone granny flats. It’s advisable to consult with experts to ensure that your conversion project is legally compliant.

How to Check Zoning and Land Size

Determining whether your property meets the legal requirements for a granny flat involves checking its zoning and land size. This information is crucial as it dictates whether your property is eligible for a granny flat under the AHSEPP guidelines.

You can find this information by visiting the NSW Planning Portal’s Spatial Viewer website. This provides comprehensive mapping data for every address and lot in NSW, making it an invaluable resource for prospective granny flat builders.
